Terms of Use

Unless otherwise expressly agreed in writing, all goods are sold upon the following terms and conditions to the exclusion of any terms and conditions of the Purchaser and no agent or representative of PressCo Printing (the Company) has any authority to vary or omit part of or all of, these conditions.

Placement of an order with PressCo Printing shall constitute acceptance of these terms.

Quotations

Estimates or Quotations are based on the accuracy and PressCo's interpretations of the specifications submitted and are subject to review upon PressCo's receipt of the Purchaser's artwork, digital file or other materials.

Estimates or Quotations not accepted within 30 days are subject to revision.

Pricing

Our Web Site pricing is subject to change at any time.

Reproduction

Purchaser warrants and represents to PressCo that he is lawfully entitled to reproduce and copy the pictures, text and any trademarks used in the material ordered and has full authority to authorize PressCo to reproduce and copy such pictures and material.

The Purchaser shall indemnify and hold harmless PressCo from any and all loss, cost, expense and damages of any and all manner of claims, demands, actions, and proceedings that may be instituted against PressCo on grounds alleging that said printing violates any copyright or any proprietary right of any person, or that contains any matter that is libelous or scandalous, or invades any person's right to privacy or other personal or economic rights. The Purchaser shall indemnify and hold PressCo Printing harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending PressCo Printing. against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing PressCo Printing. for any legal fees and expenses it reasonably incurs in responding.  The Purchaser agrees to protect and defend and promptly defend and continue the defense, at Purchaser's own expense, PressCo from economic loss or any other harmful consequences that could arise from the work. This means that the Purchaser will hold PressCo harmless and save, indemnify, and otherwise defend PressCo against claims, demands, actions, and proceedings on any and all grounds that may be brought against PressCo this will apply regardless of responsibility of negligence.

PressCo reserves the right to use reproductions for purposes of display and other advertising purposes.

Alterations

Client Alterations/Corrections/Changes must be specified in writing and must include all corrections and changes from the original specifications. Such work performed will be charged at PressCo's current rates.

Cancellations:

A request to cancel should be done by phone 770-984-1000 and followed up in writing by email or letter to prevent the job from moving forward in the production process. Orders cancelled prior to preflighting your files are subject to a $15.00 processing fee. Orders canceled after the preflighting process commences will incur a minimum $35 cancellation fee plus compensation for any other incurred costs and related obligations at the time of cancellation. Orders cannot be cancelled after you have approved (or waived) your proof.

Returns/Refunds:

Since all products are custom made to your specifications and cannot be reused or resold to other clients all sales are final.

Claims for defects, damages or shortages must be made within 5 days after your package arrives. Failure to make such claim within the stated period shall constitute irrevocable acceptance and admission that the products fully comply with the terms, conditions and specifications

Orders may not be returned without prior written authorization from PressCo. Orders returned must be done so at the client's expense. No credit or replacement will be issued without prompt return of the entire order. Every single sheet, or item, that was sent to you must be returned unused. The final decision on any claim will be based on whether, in PressCo's sole opinion, a) a "normal reproduction" loss has been made, and b) the claimed defect affects the sale ability or usability of the merchandise. In any event, PressCo's responsibility shall be limited to correction or replacement of the product, or at PressCo's option a credit allowance in whole or part.

IMPORTANT ! Under absolutely no circumstances will postage be refunded or replaced for any reason once a job has been delivered to the Post Office.

Proofing

PressCo is responsible to print your job to match your final approved proof. If there is a variation, other than color variations, between your final approved proof and the product PressCo will replace the work at no cost to you.

Final proof approval is the responsibility of the purchaser. No job is sent to press without a Proof Approval or waiver of proof.

Your proof approval certifies that you have thoroughly and fully reviewed and approved for printing your proof as supplied by PressCo. You understand that there may be differences between your original file and the proof.  It is the proof content and not your original file that you are approving. PressCo will not be responsible for any copy or design errors including but not limited to; incorrect dates, numbers, misspelled words, hidden or otherwise distorted images, text re-wrapping etc. that appears in your final approved proof.

Color Matching

PressCo offers products printed to "pleasing color" standards using standard ink densities. Because of differences in equipment, paper, inks, and other conditions between color proofing and production press room operations a variation in color between digital color proofs is to be expected and will be considered acceptable performance.

PressCo will use its best efforts to produce a high quality reproduction of the original or proof, but does not warrant an "exact color" match under any circumstances. Nor will we guarantee that we can match colors to any of the following:

Colors as seen on your computer monitor.
Colors as seen on laser, ink jet and other types of hard copy proofs.
Colors as seen on previously printed orders.
Colors from original photographs, slides or other sources.

Liability 

Disclaimer of Express and Implied Warranties: PressCo warrants only that the work will conform to the description contained on the order form. Proofs, samples, copy, dummies, and preparatory work shown to or supplied by customer are intended to illustrate the general type and quality of work. They are not intended to represent the actual work performed. PressCo's maximum liability, whether by negligence, contracts, or otherwise, will not exceed the return of the amount invoiced for the work in dispute. Under no circumstances will PressCo be liable for specific, individual or consequential damages. PressCo will use its best endeavors to deliver at the time stated and all delivery dates shall be regarded at best as estimates only. The purchaser must accept the actual delivery date and the PressCo shall not be liable for any losses, costs, damages or expenses suffered by the purchaser or any other party as a result of any delay in delivery. PressCo Printing warrants that every product manufactured by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. Print Runner, Inc. makes no other warranty and no actions or words of PressCo Printing or its officers, employees or agents shall constitute a warranty.

YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. Preparatory Work

Art work, sketches, copy, dummies, type, separations, negatives, positives, plates, digital files, creative work, and all preparatory work furnished by PressCo shall remain PressCo's exclusive property, and no use of same shall be made nor may any ideas obtained there from be used, except by written permission of PressCo and upon compensation (if any) to be determined by PressCo.

Over Runs & Under Runs

PressCo will exert its best effort to ship the exact quantity ordered plus a small additional amount.  There is no extra charge for the additional amount. In the event of a significant under run PressCo may bill for the actual amount quantity delivered. The generally accepted trade practice is plus or minus 10% - order accordingly.

The counts in all packages are electronically verified and the package weights recorded prior to shipping.

True shortage claims, receiving less product than you paid for, are extremely rare and almost always come from shipments that are further processed by a Mail House or other processing facility where spoilage occurs. Where exact counts are critical please allow for waste factors for the additional third party processing by ordering enough of an item to cover any anticipated spoilage.

Claims for shortages cannot be honored unless we can substantiate that our electronically verified counts are incorrect.

Production Schedules

PressCo expresses production times in terms of normal workdays from receipt of final proof approval to shipment. Weekends, holidays, and transit times are not included.

Production schedules are subject to the normal variations customary in the industry, and delays due to fire, strikes, equipment breakdown, inability to obtain materials, and any other circumstances beyond PressCo's control. Such delays shall not serve to invalidate any order or subject PressCo to damages. Where the date of shipment is specified on the order and for any reason it is not possible to ship on or before the date specified, PressCo will use its best efforts to ship as soon as possible thereafter and Purchaser agrees to accept the merchandise when so shipped.

Communications

To avoid any misunderstanding, and to ensure that all customer work is processed in an orderly manner all instructions should be in writing. Instructions not provided in writing may lead to problems for which we cannot be responsible. When you send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Original Materials

PressCo shall take reasonable care of artwork, digital files, original copy, and other original materials left in PressCo's possession, but PressCo shall not be responsible for it as to loss or damage while in PressCo's custody. In recognition of the foregoing and as a material inducement to PressCo to enter into this agreement, Purchaser represents to PressCo that Purchaser has a duplicate of any and all original materials supplied in their possession.

Shipping Terms

Prices are FOB PressCo's dock shipping charges to be paid by customer. All items purchased from PressCo Printing are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Standard carrier insurance through UPS or the equivalent applies. Purchaser's recourse for loss or damage in transit is solely against the carrier. PressCo will gladly assist the Purchaser who wishes to replace any damaged or lost product by filing any such claim for them with the carrier provided the purchaser has indicated damages on the carrier's documentation when the goods are signed for. If the damages were not indicated upon receipt the purchaser must promptly notify and have the carrier inspect the damages.

If requested PressCo will replace the damaged contents and charge you for the replacement. If the reimbursement from the carrier is issued to PressCo, PressCo will then issue a refund to the purchaser not to exceed the amount of the claim payment by the carrier, when and if the carrier honors the claim and makes payment. Optionally you may choose to wait until the claim is paid before replacing the damaged product.

Storage

Storage charges on material held more than 30 days after job completion will be billed at current rate per skid or square foot of space used on a monthly basis. If the storage fees are not paid and the materials are not picked up for 90 days they will be discarded the purchaser or remains responsible for payment in full for the discarded material.

Taxes

All taxes and assessments levied by any governmental authority are the responsibility of the customer. All amounts due for taxes and assessments will be added to the customer’s invoice. No tax exemption will be granted unless the customer’s “Exemption Certificate” (or other official proof of exemption) accompanies the order. If, after the customer has paid the invoice, it is determined that more tax is due, then the customer must promptly remit the required taxes to the taxing authority or immediately reimburse PressCo for any additional taxes paid.

PressCo Printing’s trademarks and trade dress may not be used in connection with any product or service that is not PressCo Printing’s, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits PressCo Printing. All other trademarks not owned by PressCo Printing or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by PressCo Printing or its subsidiaries.

You’re Account

If you use this site, you are solely responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

Privacy Policy

Your privacy is very important to us. Your information will only be used to complete your order. Under no circumstances will your information be sold or used for any other purpose. Any information PressCo collects from order processing or from any inquiries is not shared with any other company. Your information is only used for contact, billing, and shipping purposes. Your credit card information is never stored by PressCo.

Applicable Law

You agree that the laws of the state of Georgia, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and PressCo Printing or its affiliates. 

Changes

PressCo. may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless stated otherwise. This policy was last revised on March 31, 2011
